The ACLU filed an Amicus Brief on April 24, 2017 arguing that an unintentionally made voicemail recording of a domestic violence incident is a private conversation and can fall within the protections of the Privacy Act. We argue however, that in this case, the violent incident recorded falls within a bodily threat exception to the Act and that the recording could be used as evidence.
