The ACLU of Washington, Northwest Immigrant Rights Project, and ACLU Immigrant Rights Project filed a class action lawsuit on behalf of noncitizens challenging the federal government’s policy and practice of denying the authority of Immigration Judges to release noncitizens eligible for bond on conditional parole under 8 U.S.C. § 1226(a). Despite the plain language of the statute, Immigration Judges uniformly deny requests for release without monetary bond for individuals who are low flight risk and not dangers to the community and require individuals to pay a monetary bond of at least $1,500 to be released. This lawsuit seeks declaratory and injunctive relief clarifying that Immigration Judges have the authority to release individuals on conditional parole.
